Lehman Luxembourg Affiliate Seeks Bankruptcy in US

Bankrupt Lehman Brothers Holdings Inc.’s affiliate Luxembourg Residential Properties Loan Finance filed for bankruptcy court protection in New York.

The Chapter 11 petition, filed today in U.S. Bankruptcy Court in Manhattan, lists assets and debt of more than $1 billion each. According to court documents, the Luxembourg-based company is affiliated with Lehman Brothers and seeks to be consolidated with Lehman’s bankruptcy case. Luxembourg Trading Finance S.a.r.l. owns 100 percent of the affiliate’s equity, according to court documents.

Lehman filed the largest bankruptcy in history on Sept. 15, saying it had debt of $613 billion. It sold its broker-dealer unit to London-based Barclays Plc, the U.K.’s third-biggest bank, on Sept. 19.

Other real estate-related Lehman affiliates, including an apartment complex unit in Cleveland, also filed for Chapter 11 protection. PAMI Statler Arms LLC, which sought bankruptcy Sept. 23, listed assets of $20 million and debt of $38.5 million.

Lehman Brothers Holdings Inc. said in an annual filing Jan. 29 that various subsidiaries in European countries including Luxembourg, Switzerland and Italy are overseen by regulatory authorities in those countries. It didn’t have any other information about Luxembourg operations in its filing.

According to Bloomberg data, Lehman Brothers Luxembourg SA is a subsidiary of Lehman Brothers Holdings Inc.

Alfredo Perez, a lawyer for Luxembourg Residential Properties, didn’t immediately return a call and e-mail seeking comment on whether the debt listed was combined with Lehman Brothers.

The case is In re Luxembourg Residential Properties Loan Finance S.a.r.l., 09-10108, U.S. Bankruptcy Court, Southern District of New York (Manhattan). Lehman’s case is In re. Lehman Brothers Holdings Inc., 08-13555, U.S. Bankruptcy Court, Southern District of New York (Manhattan).
